For many people, when they are being threatened by foreclosure they often feel as if nothing can be done to stop it; however, this simply isn't true! Something can be done to stop foreclosure and at our firm, we have been helping families fight foreclosure proceedings for 25 years. We can tie up a foreclosure process in court for a long period of time and sometimes we can convince the lender to accept a loan modification and halt the foreclosure proceedings.

There are several viable alternatives to foreclosure but it's important to contact an attorney as early as possible in the foreclosure process. Once you receive a letter indicating that your lender will begin foreclosure proceedings against you, it's vital that you hire a competent foreclosure attorney right away. If you are served the Summons and Complaint personally, then you have just 20 days to respond to the Summons and Complaint. On the other hand, if you are served the Summons and Complaint by some other means than in person, then you have 30 days to respond. Keep in mind that calling the attorney who served you the foreclosure papers is not considered a valid response.

You must file your Formal Answer where you respond to each allegation in the complaint against you. If you have defenses, you must use this opportunity to assert them. Your Verified Answer to the Summons and Complaint in foreclosure must be acknowledged before a Notary Public. What's more, it must be served on the opposing counsel and the court as well.

We can discuss such options as:

  • Bankruptcy - filing for bankruptcy will place an automatic stay on foreclosure proceedings. With a Chapter 7 filing, this may buy you time to figure out a solution. With a Chapter 13 filing, you may be able to incorporate past due payments into your repayment plan and save your home.
  • Loan modification - your lawyer may be able to negotiate with your lender to modify your existing loan. This may include a change in your interest rate, working out a payment plan for past due payments, lowering your monthly payment or even lowering the principle balance.
  • Short sale - you may be able to work out an agreement with your lender wherein you sell the property for less than you owe but are forgiven the balance, meaning you have no obligation to pay the difference.
  • Deed in lieu - you may be able to give the property back to the lender in exchange for having your mortgage loan marked as "paid" although the property is worth less than what you owe.

There may also be ways we can dispute the validity of the foreclosure itself. Did the lender make a mistake? Were you the victim of predatory lending or fraud? Does the lender bringing the foreclosure lawsuit against you actually have control of or own your mortgage loan?
